we all got a section 59 the other day.. anybody else had one

What was the reason for getting one, and what action did they threaten you with?

we nearly got one about a year and a half ago but convinced the police that we were on byeways and since the coppers didnt have a clue we got spared....
It is issued if the police suspect you of illegally riding, they dont have to prove you have been, just suspicion is enough.
get 2 in 12 months and they confiscate your vehicle,you then pay around £120 for the recovery and £12 per day storage and you get it back.
A group of quadders got one a while back as they were parked in a layby next to some woods, a copper pulled over and because they were muddy put 2 and 2 together and got 5 and so issued them all with it as he thought they had been in the woods.
Have had copper pull up behind me at home and demand to know where i have been as covered in mud (bet he was itching to issue sec.59) but told him byeways and where they were so again,didnt get one.
It can really suck !

Just reading this interesting post, you say the rozzers can just issue you with a section 59 on suspicion which I dont doubt, but what if you showed them evidence that you were riding legally, I refer to showing them the track you had just ridden on something like the Road Angel device, it shows the route you have been riding, how could they dispute that evidence .
Mind you, they would have to know the byway symbols on the OS map and pink crosses might confuse them .

you can doubt it all you like graham but that is the way it is mate.
Section 59 Police Reform Act 2002 states that -
Where an officer has reasonable grounds for believing that a motor vehicle is being used in a manner which contravenes Road Traffic Act Section 3 (Careless Driving) OR Section 34 (Driving elsewhere than on a road) AND also the manner of use of the vehicle is causing or has been causing or is likely to cause, alarm distress or annoyance to members of the public, Section 59 can be used.
so if some ramblers claim you causing annoyance or alarm (go fly round a bend and meet them for instance) - do i need to say anymore?

Basically as with most of the police/traffic acts the snouters can do what they want when they want and dont have to have much if any proof to do it:frusty:. The more proff/evidence you have with you at the time the better. It usually comes down to how you speak to them, your tone of voice, your body posture:hug:, wether you co-operate etc etc and if they gota get back to the station for a cupa

I dont doubt it secret, the evidence on your sat nav could be useful though .
I think rob is right, sometimes its how you react that counts .
When I killed my first wife I acted nice and only got 17 years :eek::scared:only joking guys .

Is it just me or is this country turning into a Police State, if you can be prosecuted without evidence and on someone elses story too :eek:
I have been questioned by Police when on the quad on two occasions, both times they were fascinated by the machine and wanted to know how much they cost and from where, did not even ask about insurance etc .
The best thing we can do is to be careful and try not to upset any body whilst out riding and show respect to others .

Is it just me or is this country turning into a Police State, if you can be prosecuted without evidence and on someone elses story too :eek:

i have tried this for the last 5 years ...doesnt work mate people moan and complain even if you are doing nothing wrong...

This has been introduced since I used to wear blue. I ended up with a warning (last day with a hire car, need i say more) that would be recorded etc etc and they could seize the vehicle there and then if need be.
Thankfully was more warning than anything else as he didn't seem 100% on the technicalities and I never received a written warning as I believe has to form part of the process.
